Buyer’s Agent: Are you aware of how it works in North Carolina?
When you are purchasing property and your real estate agent is representing you as “a buyer’s agent,” then your agent is representing your best interest, NOT the seller’s best interest. Your buyer’s agent must promote your best interest, be loyal to you, follow your lawful instructions, provide you with all material facts that could influence your decisions, use reasonable skill, care and diligence, and account for all monies that he/she handles for you.
You can, however, elect to work with an agent to assist you in purchasing property who is not a buyer’s agent, but then that agent will be acting as a seller’s agent, or subagent. The agent can provide many of the same services that a buyer’s agent would provide, but just remember the agent in this case would be representing the seller, NOT you, meaning the agent has a legal obligation to obtain the best price and terms for the seller, not for YOU. The agent also has an obligation to inform the seller of any information about you that would help the seller.
